RULES OF PARTICIPATION
in Physical 2.0 Season

As used in these Rules, the following terms shall have the following meanings:

Terms and Conditions: a public contract-offer (offer) which is posted on the Company's website on the Internet at https://physical-transformation.com/offer.

The Company, We, Us or Our: FIZIKL IQ-FZCO, including any of its representatives or employees, which provides remote informational support and familiarization with available nutrition and training programs for natural persons (the “services”).

Client, You: a natural person who applied for the provision of services and accepted the offer in accordance with the Terms and Conditions.

Contract: the contract which has been concluded between the Company and the Client as a result of the acceptance of offer by the Client in accordance with the Terms and Conditions.

Platform: specialized virtual platform (software package) used for services provision according to the Terms and Conditions shaped as a mobile app and/or web app.

Platform Administration: the Company’s staff members or third parties involved in the provision of the services who directly provide services.

Season: virtual groups created on the Platform, administered by the Platform Administration over the period of time determined by the Company, one of which the Client becomes a participant based on the acceptance of the Terms and Conditions and the information specified on the Client's Personal Account.

Premium Plan: a special tariff which is characterized by a higher cost and contains an expanded list of services in addition to the standard list of services provided within the Season. The expanded list of services is determined by section VII of the Terms and Conditions.

Participant: a Client who has reached the age of 18 and has no medial contradictions for participation in the Season. Pregnancy is also an absolute contradiction for participation in the Season.

Personal Account: the Client's personal page on the Platform.


I. Acknowledgement

I.1. These Rules of Participation during the Season (hereinafter referred to as the “Rules”) provide a general set of rules which should be followed by all Participants and include the rules of participation and interaction between the Participants and the Platform Administration or with other Participants during the Season, as well as establish responsibility for violation of these rules.

I.2. In everything else that is not directly regulated by these Rules, the parties are guided by the Terms and Conditions. In case of inconsistency between these Rules and the provisions of the Terms and Conditions, the provisions of the Terms and Conditions shall prevail.

II. The Client’s obligations

II.1. In order to achieve the goals of participation, the Participant undertakes to independently and on a regular basis monitor and familiarize themselves with the information published by the Platform Administration on the Platform and in the Participant's Personal Account, read or watch all published material (articles, lectures, videos, etc.), as well as follow the recommendations of the Platform Administration. The Participant confirms their familiarization with the information by clicking a "like" button under the respective material.

II.2. If the Participant knows that for any reason (personal/family circumstances, business trip, etc.) the Participant will not be able to monitor and study the information specified in paragraph 2.1 of these Rules for three (3) or more consecutive calendar days, the Participant is obliged to notify the Platform Administration in advance in their Personal Account.

II.3. In order to achieve the goals of participation, the Participant generates reports which should contain information about the Participant’s calorie intake per day, weight, physical activity, as well as other relevant information, requested by the Platform Administration. Such reports are to be generated by the Participant in their Personal Account on a daily basis.

II.4. In order to achieve the goals of participation, the Participant measures the physical parameters of their body in accordance with the recommendations provided by the Platform Administration. After that, the Participant uploads the information to their Personal Account. Such information should be updated on a weekly basis and uploaded no later than the last day of the corresponding calendar week of the Season.

II.5. In order to achieve the goals of participation, the Participant takes and uploads to their Personal Account their full body photos (from the back, sideways, and frontally) in accordance with the recommendations provided by the Platform Administration. Such photos are to be uploaded on a monthly basis, starting from the date of the beginning of the Season.

II.6. During the Season, from the moment the first individual “Bar” has been provided to the Participant (as specified in paragraph III.1.), it is strictly prohibited to consume any alcoholic beverages. This ban does not apply to the Participants with the Premium Plan or the Participants who completed a Season at least once before. However, the Platform Administration reserves the right to restrict or prohibit such a Participant from drinking alcohol during the Season if it negatively affects the results of the Participant.

II.7. The Participant undertakes not to publish or otherwise distribute materials and information published by the Platform Administration on the Platform and in the Participant's Personal Account or provided by the Platform Administration to the Participant in any other way, without prior written permission of the Platform Administration. In each case of such permitted publication, the Platform shall be mentioned as the source of such information (materials).

II.8. Without obtaining any prior permission in accordance with paragraph II.7. of these Rules, the Participant has the right to publicly retell in their own words, including in their personal social media accounts, the information received during the Season, as well as to share any of their results, interim or final. In each case, the Platform should be mentioned as the source of such information.

III. Individual goals and feedback

III.1. Along with the recommendations posted on the Platform which are common to all Participants, the Platform Administration provides the Participant, on a weekly basis, with a set of individually calculated parameters to be met by the Participant (hereinafter referred to as the "Bar"), including, but not limited to:
- recommendations regarding the rates of daily calorie and protein intake, etc.;
- recommendations regarding daily physical activity (the minimum number of steps, etc.);
- other recommendations at the discretion of the Platform Administration.

III.2. The first Bar is provided to the Participant at the beginning of the second week of the Season. Each subsequent Bar is provided to the Participant after the Participant submits the weekly report and on its basis. After considering the Participant's weekly report, the Platform Administration may conclude that the previous set of individually calculated parameters does not require adjustment – in this case, a new Bar is not provided, and the Participant should be guided by this previous set of individually calculated parameters (the previous Bar).

III.3. Monthly, within four (4) business days from the moment the Participant uploads their photos in accordance with paragraph 2.5 of these Rules, provided that the Participant has fulfilled the obligations under paragraphs 2.3 and 2.4, the Platform Administration (the Participant's personal supervisor) sends the Participant extended feedback containing information about the Participant's progress and prospects of the achievement of the individual goals set for the Participant in the Season.

IV. Communication and Interaction rules

IV.1. All personal questions (regarding the individual Bar, etc.) are to be asked by the Participant in "My topic" section in the Personal Account.

IV.2. The Platform Administration (including the Participant’s personal supervisor) answers your questions on business days. The average response time is within twenty-four (24) hours. Weekends and public holidays are considered to be non-business days; therefore, the Platform Administration reserves the right to answer the questions asked during such periods on the next following business day.

IV.3. In case the Participant experiences any difficulties in interacting or communicating with their personal supervisor or any other member of the Platform Administration, the Participant shall inform the Company about such difficulties at the Company's e-mail address specified in clause 10.4 of these Rules.

IV.4. At the end of the 4th, 8th, 12th and 16th week of the Season, the Platform Administration holds special webinars, at which the Participant can also ask all their questions regarding the Season.

IV.5. A general chat room with the Platform Administration and all other Participants starts to work during the second week of the Season.

IV.6. The information posted by the Platform Administration or any Participants in the general chat room is not mandatory for familiarization or study. The general chat room is created solely for the purpose of providing the Participants with the opportunity to communicate with one another, receive mutual support, share and discuss the individual results in the Season.

IV.7. General chat room rules of conduct:
- any advertising is prohibited;
- it is prohibited to create or advertise any third-party chat rooms;
- it is prohibited to share information which is not related to the Season ("flood");
- voice messages are prohibited;
- any inappropriate behavior (e.g., accusations, insults, aggression) is prohibited (the Platform Administration reserves the right to assess the Participant's behavior in the general chat room at the discretion of the Platform Administration represented by its general chat room moderators);
- it is prohibited to discuss the personality or job performance of any member of the Platform Administration, including personal supervisors, moderators of the general chat room, etc.;
- it is prohibited to share information which demoralizes other participants; this includes complaints about: the Participant’s physical or emotional condition, lack of progress, etc. (these issues should be discussed with a personal supervisor in "My topic" section);
- it is prohibited to share information or post images (photographs) which do not comply with the current legislation or accepted norms of morality;
- it is prohibited to provide other Participants with recommendations regarding nutrition or training (during the Season, this right belongs exclusively to the Platform Administration);
- it is prohibited to post recipes and cooking guides (for this purpose, the Platform Administration creates a special additional chat room, as well as a separate topic in the Community section);
- any discussion of medical diseases, conditions or treatment, including provision of medical advice, is strictly prohibited;
- it is forbidden to ask any questions concerning the Participant’s personal "Bar" (these issues should be discussed with a personal supervisor in "My topic" section).

IV.8. The moderators of the general chat room monitor the compliance with the general chat room rules provided by paragraph 4.7 by each Participant. The Platform Administration, represented by the general chat room moderators, reserves the right to decide whether the information and images (photos) posted by the Participant comply with the general chat room rules. In case the information or image (photo) posted by the Participant does not comply with the general chat room rules, the moderators have the right to delete such information or images (photos) or exercise the rights provided by paragraph VIII.3 of these Rules.

IV.9. Special Communication and Interaction rules for the Participants with the Premium Plan:

IV.9.1. The Participant with the Premium Plan has the right to interact with the Platform Administration both on the Platform itself or on Telegram, where voice messages are not prohibited.

IV.9.2. The average time the Platform Administration responds to the Participant with the Premium Plan is within two (2) hours. The Platform Administration provides feedback and answers the Participant’s questions even on weekends. In urgent cases, the Platform Administration may respond at nighttime. The question of whether to consider the case urgent is at the discretion of the Platform Administration.

IV.9.3. The Platform Administration carries out additional online meetings as follows*:
  • One (1) initial 45-minute meeting.
  • Four (4) 60-minute meetings to provide feedback and discuss the Participant’s results and individual goals (at the end of each month of the Season).
  • Twelve (12) 30-minute meetings to provide feedback and discuss the Participant’s results and individual goals (at the end of each week of the Season).
*The maximum number of meetings and their maximum duration. The time of each meeting is to be determined by the Platform Administration and the Participant subject to the time intervals proposed by the Platform Administration and suitable for the Participant.

IV.9.4. The Participant with the Premium Plan has the right to receive the services specified in section 7 of the Terms and Conditions. In case the Participant wants to receive any of these services, the Participant shall inform the Participant’s personal supervisor by contacting them on the Platform or on Telegram.

IV.9.5. In order to provide services to the Participant with the Premium Plan, the Company appoints a specialist from the Platform Administration, who serves as the Participant’s personal supervisor during the Season and has knowledge and expertise both in nutrition and training. In order to provide Services to the Participant outside the Participant’s personal supervisor’s working hours, the Platform Administration appoints another acting supervisor.

V. Trial Period

V.1. The first seven (7) days of the Season are considered to be a trial period. During the trial period, the Participant has the right to unilaterally and without giving reasons refuse further participation in the Season and receive a refund of the paid cost of the relevant services in full.

V.2. After the expiration of the period specified in paragraph 5.1, the Participant's refusal to participate in the Season and the corresponding refund of funds are carried out in accordance with the provisions of the Terms and Conditions.

VI. Medical contradictions

VI.1. The Company and the Platform Administration do not provide medical services, do not diagnose any diseases, do not prescribe treatment, and do not interpret or comment on the medical tests results of the Participants.

VI.2. By accepting the Terms and Conditions and concluding the Contract, the Participant confirms that they have no medical contraindications for the participation in the Season.

VI.3. The Participant takes complete and sole responsibility for the state of their health. If the Participant has concerns about the presence of medical contraindications for the participation in the Season that arise before the conclusion of the Contract or during its validity period, or if the Participant starts to experience any negative symptoms during the Season, the Participant must immediately seek appropriate medical advice from their physician or healthcare provider and follow the recommendations of such physician or healthcare provider.

VI.4. The Participant is obliged to immediately inform the Platform Administration about any deterioration in the Participant’s health and/or about the appearance of any negative symptoms during the Season.


VII. Sports Training

VII.1. Sports training during the Season is recommended by the Platform Administration but is not mandatory.

VII.2. The Platform Administration publishes ready-made gym, home and/or outdoor workout programs. The Participant, at his discretion, has the right to choose a suitable training program from those presented by the Platform Administration, or any other training program (type of sports activity), or to decide not to train.

VII.13 The Participant decides whether to follow the recommendations of the Platform Administration regarding sports training at their own discretion, taking into account their health and physical condition, endurance, strength, etc.

VII.4. Upon the Participant's request and for an additional fee, the Company can offer additional services that include providing the Participant with pre-designed or personalized workout programs tailored to the Participant's individual characteristics and requirements. The provision of such services is carried out by the Company on a separate platform - TransformMate mobile app. In accordance with paragraph VII.1.6. of the Terms and Conditions, the Premium Plan also includes individual programming of training (IPT Services) for the duration of the Season; the cost of such services is included in the price of the Premium Plan.


VIII. Liability Provisions

VIII.1. For violation of these Rules, the Participant is held liable in accordance with the Terms and Conditions and the provisions of these Rules.

VIII.2. In each case of violation of the provisions of paragraph 2.6 of these Rules, on the day following the day of such violation the Participant is obliged to perform one of the following actions:
- perform one hundred (100) burpees and provide the Platform Administration with a full video recording of the performance;
- take thirty thousand (30,000) steps in one day and provide the Platform Administration with a screenshot from their chosen step counter mobile application which confirms the number of taken steps;
- pay a fine in the amount of fifty (50) UAE dirhams to the Company's bank account.
If the Participant fails to fulfill the obligations provided for in this paragraph, the Contractor reserves the right to refuse to provide the services unilaterally without returning the paid cost of the relevant services to the Participant.
The provisions of this paragraph VIII.2 do not apply to the Participants with the Premium Plan.

VIII.3. In case of violation of the provisions of paragraph IV.7 of these Rules, the Contractor reserves the right (without any further explanation) to ban the Participant from the general chat room until the end of the Season or until the date of termination of the Contract.

IX. Confidentiality of the Participant’s data

IX.1. The Company and the Platform Administration shall take all necessary technical and organizational measures to ensure the protection of confidential information received from the Participant before or during the Season. Personal data, as well as other information posted by the Participant in the Personal Account, except for the information posted by the Participant in the general chat room, are available only to the Participant and the Platform Administration and are used by the Platform Administration only for the purposes stated in the applicable Privacy Policy.

X. Other provisions

X.1. The Company offers the Participant who has completed the Season a full access to the Season Content in the web version of the application for three (3) additional months following the end of the Season. For the Participants with the Premium Plan, this period is extended to twelve (12) months.

X.2. These Rules are an integral part of the Terms and Conditions and the Contract.

X.3. The Company reserves the right to unilaterally amend these Rules from time to time. Any updates will come into force at the moment of publication of such updates on the Company’s website at https://physical-transformation.com/rules/ and apply to the Contracts concluded after the moment of such publication.
