FIZIKL IQ-FZCO: a company, registered with the Dubai Integrated Economic Zones, the United Arab Emirates, with license number 32779 (the “Company”), publishes this document (the “Policy“), which is addressed to the Participants who have applied for the provision of the services in accordance with the Personalized Workout Plans (PWP) Terms and Conditions.
1. General provisions
1.1. This document sets out the principles of ethical conduct and communication practices in the course of interaction between Participants, the Company, and the Chat Moderator using the functionality of the Personalized Workout Plans (PWP) Participants Chat in Telegram (the “PWP Chat”). The provisions of this Policy apply to all participants in communication, including the Chat Administrator and other authorized persons of the Company responsible for technical support and/or moderation.
1.2. The purpose of this document includes improving the quality and predictability of communication, reducing conflicts, maintaining a respectful environment, protecting the dignity and interests of users, and fostering a culture of safe and responsible training. The Company develops the PWP Chat to increase trust and reduce risks. At the same time, the Company acts as a technology service and does not assume obligations relating to the content and outcomes of the Participants’ actions, communications, and training practices, except where the Terms and Conditions expressly provide otherwise.
1.3. The provisions of this document apply to the extent they do not conflict with the Terms and Conditions and the rules of applicable law. In the event of any discrepancies between this document and the Terms and Conditions, the provisions of the Terms and Conditions prevail.
1.4. This document has an organizational and ethical nature. It does not establish medical standards, does not replace a physician’s consultation, and does not contain any promise of a result. The Company does not act as a party to relationships between Participants, does not assume an obligation to settle disputes between Participants, and does not guarantee the accuracy, completeness, or applicability of statements and recommendations posted by Participants.
1.5. The PWP Chat is not intended for emergency assistance. In case of a threat to life and/or health, as well as in acute conditions, the Participant is advised to stop potentially risky actions and contact emergency services and a qualified medical specialist. Messages and information in the PWP Chat, including the Moderator’s comments, have informational and organizational purposes and do not create individual medical, psychological, or other professional advice.
1.6. Access to the PWP Chat and/or continued participation in it confirms that the Participant has read this Policy and agrees to comply with its provisions. If the Participant does not agree with this Policy, the Participant is advised to refrain from participation in the PWP Chat and use other interaction channels provided by the Terms and Conditions.
2. Terms and definitions
2.1. Company: FIZIKL IQ-FZCO, a company registered in Dubai Silicon Oasis, Techno Hub 2, 66th Street, Nr 20, I132-H, Nad Al Hessa, Dubai, the UAE, License Number: 32779.
2.2. Participant: a natural person who has reached the age of eighteen (18) and has applied for the provision of the Services in accordance with the Terms and Conditions.
2.3. Platform: specialized virtual platform (software package) used for the provision of Services in accordance with these Terms and Conditions and shaped as a mobile application – TransformMate mobile app.
2.4. Content: informational materials, exclusive rights to which belong to the Company, posted by the Company or the Platform Administration on the Platform, namely: training programs; lectures, video materials (including video lectures), and articles; photos and any other images as well as any other materials posted on the Platform and used by the Company to provide the respective services.
2.5. Personalized Workout Plans (PWP) Participants Chat in Telegram / PWP Chat: a software program, as well as databases within the software program, available to the Participant in Telegram and intended for interaction between Participants via the messenger interface. Access to the Chat is provided by the Company to the Participant as part of the provision of Services to the latter in accordance with the Terms and Conditions.
2.6. Chat Moderator / Moderator: representative of the Company (an employee and/or a third party engaged by the Company on legal grounds to provide Services under the Terms and Conditions) who checks, filters and manages text messages, photos, videos and comments posted by Participants within the PWP Chat (the “User Content”) for compliance with applicable law and this Policy;
2.7. User Content: any information and materials posted by the Participant in the PWP Chat, including text, images, audio, video, files, hyperlinks, reactions, and other forms of expression. The Participant who posted the User Content bears responsibility for the lawfulness and content of the User Content, unless applicable law provides otherwise.
2.8. Communication: the exchange of messages, materials (photos, videos, and other forms of content), and comments among Participants with the participation of the Moderator using the functionality of the PWP Chat.
2.9. Chat Administrator / Administrator: an authorized person of the Company with rights to manage settings and access to the PWP Chat in Telegram, including rights to delete content, restrict publications, and block access. When performing such actions, the Administrator acts in the interests of the Company and for the purpose of compliance with the Terms and Conditions and this Policy.
3. Basic principles of ethical conduct
3.1. Respect and non-discrimination. Communication must not include statements or actions that demean dignity, including on grounds of gender, age, origin, language, religion, health status, appearance, body features, or other circumstances.
3.2. Priority of safety and prevention of harm. Communication must not encourage dangerous behavior, ignore alarming symptoms, or include discussions of medicinal products, treatment regimens, or other matters relating to medical care. If complaints about well-being arise, the priority includes stopping potentially risky actions and recommending that the Participant seek medical advice, without interpreting symptoms as a medical conclusion. Messages aimed at inciting life-threatening acrobatic or other physical elements, self-harm, suicidal actions, or other knowingly dangerous behavior are prohibited.
3.3. Professional distance and conflicts of interest. Communication between Participants and the Moderator is conducted exclusively for the purposes of providing services and support under the Terms and Conditions. Actions that create dependence, pressure, manipulation, or the imposition of communication outside the purposes of the service are not allowed. Misuse of an official position for personal benefit contrary to the Terms and Conditions is not allowed. Unless the Terms and Conditions provides otherwise, the Company does not initiate or support individual financial settlements, fundraising, or investment proposals between Participants within the PWP Chat.
3.4. Confidentiality and respect for privacy. Participant information, photos, and video materials must be handled with due care. Disclosure to third parties or publication of information without a legal basis and the Participant’s consent is prohibited, except as provided by the Terms and Conditions and applicable law. The Participant independently assesses the risks of disclosing information about themselves in the PWP Chat, including the risk of dissemination by third parties outside the Company’s control, taking into account the technical features of Telegram and the personal data processing policies of its rights holder.
3.5. Prohibited content. Insults, threats, sexual harassment, stalking, publication of other persons’ personal data, calls for dangerous actions, and any content that violates third-party rights and the rules of applicable law are prohibited. Defamatory messages, intentional dissemination of knowingly false information, impersonation, political calls and campaigning, as well as any actions aimed at circumventing restrictions imposed by the Moderator or the Administrator are prohibited.
4. Procedure for organizing communication
4.1. All actions performed within the Chat using the Participant’s account are deemed performed by the Participant unless otherwise proven under applicable law. The Participant independently ensures the security of credentials, devices, and means of access to Telegram and promptly notifies the Company if unauthorized access is suspected.
4.2. The Participant must not provide third parties with access to the PWP Chat using the Participant’s login/password data and Telegram account.
4.3. Communication in the PWP Chat does not operate on a twenty-four (24) hour basis. The Company and the Moderator may set time windows for moderation and responses, as well as technical breaks, based on the organizational and technical capabilities of the service.
4.4. Based on the purposes of this Policy, the Company may restrict certain PWP Chat functions (including the ability to comment, publish media files, use reactions, conduct polls) for a specific period without a prior notice obligation if this is necessary to ensure order, safety, and compliance with applicable law.
4.5. The Participant must comply with the rules of Telegram, including community rules and other documents of the service owner. Restrictions imposed by Telegram, including blocking, functionality limitations, and content removal, may be applied independently of the Company’s actions, and the Company bears no responsibility for such restrictions.
4.6. The Company does not organize or control meetings and interactions among Participants outside the PWP Chat functionality. Any arrangements among Participants regarding in-person meetings, joint training, or exchange of goods or services are made independently by the Participants and at their own risk.
5. Restrictions on publishing certain content
5.1. Within the Chat the following actions are prohibited:
5.1.1. Posting advertisements, hidden promotions, offers of goods and services unrelated to the service, as well as fundraising and any commercial activity.
5.1.2. Posting invitations to external chats and communities, unless the Terms and Conditions provides otherwise.
5.1.3. Flooding and messages that hinder reading and moderation of content, including systematic posting of identical short messages outside the purpose of communication.
5.1.4. Message formats prohibited by the chat rules if the relevant restrictions are set by the Terms and Conditions.
5.1.5. Discussing diagnoses, treatment regimens, medicinal products, and other medical issues, as well as requesting/providing medical advice.
5.1.6. Demeaning dignity, aggressive communication, stalking, bullying, threats, and incitement of hatred.
5.1.7. Posting materials that violate third-party rights, including copyright and image rights, as well as materials that violate the rules of applicable law.
5.1.8. Posting third-party personal data without their consent, as well as posting payment details, documents, passwords, access codes, or other information that creates a risk of financial loss and/or fraud.
5.1.9. Posting materials containing pornographic images, scenes of cruelty, as well as content capable of causing psychological harm to minors.
5.1.10. Distributing malware, phishing links, instructions for bypassing protective mechanisms, as well as other information aimed at committing unlawful acts.
5.2. The Company may introduce additional organizational rules, including restrictions on content and message formats, if this is necessary to maintain order and reduce conflicts within the PWP Chat.
5.3. Copying, distributing, publishing, or otherwise using Content outside the Platform is prohibited, including by forwarding, downloading, publicly posting, providing access to third parties, and creating derivative materials, unless the Company has expressly provided written permission and unless applicable law provides otherwise.
5.4. By posting User Content, the Participant confirms that they have all necessary rights and consents (including consents of persons depicted in photos and videos) and grants the Company a simple (non-exclusive) royalty-free license to use the User Content within the scope necessary for:
5.4.1. Ensuring the functioning of the PWP Chat.
5.4.2. Moderation and handling requests.
5.4.3. Performance of the Terms and Conditions.
5.4.4. Compliance with applicable law.
5.4.5. Protection of the Company’s rights and legitimate interests.
6. Moderation, response measures, and notifications
6.1. Moderation of the PWP Chat aims at maintaining orderly communication. Moderation does not mean that the Company assumes an obligation to prevent all possible risks and conflicts.
6.2. If violations of communication rules are identified, the Moderator may apply response measures, including:
6.2.1. Deleting a message or content.
6.2.2. Issuing a warning.
6.2.3. Temporarily restricting the ability to post messages.
6.2.4. Other measures provided by the Terms and Conditions, including restricting access to the PWP Chat for a specified period or indefinitely. Measures may be applied without prior warning if, in the Moderator’s or Administrator’s assessment, the violation creates a risk of harm, violation of third-party rights, or violation of applicable law. Measures may be combined and applied repeatedly depending on the nature, severity, and recurrence of violations. Refund and recalculation matters in connection with access restriction are governed by the Terms and Conditions.
6.3. The Company may record the fact of a violation and the measures applied in an internal accounting system to the extent necessary for handling requests and ensuring the operation of the service. Such records may include screenshots, technical logs, message identifiers, links, metadata, and other service information necessary to protect the Company’s rights and legitimate interests and/or to meet applicable law requirements.
6.4. The Company bears no responsibility for, and does not endorse, any User Content posted in the PWP Chat by a Participant. The Company has no obligation to track, edit, or delete any User Content. Opinions expressed by other Participants do not reflect the Company’s views or values.
6.5. The Company has no obligation to monitor access to or use of the PWP Chat, nor to purposefully review or edit any User Content. However, the Company reserves the right, without assuming any obligations, to monitor, moderate, edit, restrict access to, or delete User Content (whether moderated or not) which, in the Company’s opinion, violates the Terms and Conditions and the communication rules set out in this document. The Company may provide information and materials to competent authorities upon receipt of a lawful request, or if there are indications of a threat to life and/or health, or other circumstances requiring a lawful response.
6.6. The Company uses a combination of automated and manual moderation methods to identify User Content that violates the Terms and Conditions and the communication rules set out in this document. The Company may also consult and cooperate with law enforcement agencies to support the prosecution of persons violating applicable law.
6.7. The Company bears no responsibility for Participants’ conduct within the PWP Chat. The Company does not verify Participants’ statements posted in the chat. The Company does not conduct background checks and does not investigate Participants’ biographies by other means. Verification of data relating to age, identity, and other data necessary for providing services is performed based on best technical practices, and the Company cannot guarantee the accuracy or correctness of such verification. The Company has no obligation to perform additional verification of a Participant’s identity, qualifications, or status unless such verification is expressly required by the Terms and Conditions and applicable law.
6.8. The PWP Chat may contain links to third-party websites and services. If the Participant decides to visit any third-party website or use third-party services, the Participant does so at their own risk. The Company provides access to such resources solely for convenience and bears no responsibility for the content, products, or services posted on or available via such resources or links.
6.9. The Company bears no responsibility for malfunctions, functionality limitations, blocking, changes of rules, or other actions of third parties affecting the operation of Telegram, as well as for the quality of Internet access and the Participant’s equipment. Temporary unavailability of the PWP Chat for technical reasons does not constitute a breach of the Company’s obligations unless the Terms and Conditions provides otherwise.
6.10. The Company may refrain from disclosing to PWP Chat participants the detailed grounds for moderation decisions if disclosure may breach third-party confidentiality, hinder prevention of violations, or create other legal and/or organizational risks.
6.11. Removed User Content may be technically unavailable for restoration. The Company does not assume an obligation to restore deleted messages and materials unless applicable law provides otherwise.
7. Handling requests, dispute resolution, and escalation
7.1. If claims arise regarding communication, moderation, or organizational support of the PWP Chat, the Participant is advised to submit a request via the PWP Chat or to the email ID: info@physical-transformation.com. Requests related to violations of intellectual property rights and/or unlawful dissemination of personal data are advised to be submitted with supporting materials and information necessary to identify the disputed content.
7.2. For prompt review, the request is advised to include the account identifier, date and time of communication, description of the situation, a link to the messages or attached screenshots, and the requested resolution.
7.3. Requests are reviewed within ten (10) business days from the date the request is submitted to the Company. If additional information must be requested from the Participant or third parties, the review period may be extended for the time needed to obtain such information, and the Participant is notified using an available method.
7.4. The Company may refuse to review a request if it:
7.4.1. Does not contain information sufficient to identify the situation.
7.4.2. Contains threats, insults, or abuse of rights.
7.4.3. Is submitted anonymously and does not allow identification of the applicant.
7.4.4. Relates to matters not connected with services under the Terms and Conditions and the functioning of the PWP Chat.
7.5. Abuse of the request mechanism (including mass unfounded complaints and false reports of violations) may be treated as a violation of this Policy and may result in moderation measures under section 6 of this Policy and the provisions of the Terms and Conditions.
7.6. The Company reviews requests within its organizational powers and does not assume the functions of arbitration or mandatory conciliation between Participants.
8. Confidentiality, personal data, and safe practices
8.1. Communication participants are advised to follow the principle of minimum necessary disclosure of information and refrain from posting phone numbers, addresses, document details, payment data, and other personal data in the chat.
8.2. Before sending photos, videos, or other materials, participants are advised to ensure that such materials do not contain excessive personal data of third parties. If third parties appear in the frame, obtaining their consent is advised.
8.3. If the PWP Chat functionality provides privacy settings, communication participants are advised to use them to control the group of persons who can access materials, within the capabilities of the service.
8.4. The Participant acknowledges that Telegram is a third-party service applying its own rules and information processing policies. The Company does not control data processing by Telegram and bears no responsibility for actions and decisions of the owner of such service.
8.5. The Company processes Participants’ personal data for the purpose of performing the Terms and Conditions, ensuring the functioning of the PWP Chat, moderation, handling requests, and compliance with applicable law, in the scope and manner provided by the Terms and Conditions and the Company’s Privacy Policy.
9. Role of the Company, disclaimer of liability, and absence of warranties
9.1. The Company provides technological infrastructure and does not assume obligations:
9.1.1. To pre-moderate the content of private correspondence between Participants.
9.1.2. To ensure that the Participant achieves specific results.
9.2. The Company bears no responsibility for actions or omissions of the Participant or other persons regarding the content of messages and decisions made based on such messages, to the maximum extent permitted under applicable law. The Company bears no responsibility for indirect losses, lost profit, moral harm, and other adverse consequences arising from the use of the PWP Chat and/or following third-party recommendations, except where such liability is expressly required by applicable law and/or the Terms and Conditions.
9.3. This document reflects practices promoted by the Company within the service in the interests of respectful and safe communication. Promotion of these practices does not create an obligation for the Company to control all communications and prevent any negative consequences. The Company does not guarantee uninterrupted operation of the PWP Chat, absence of errors, compliance of the PWP Chat with the Participant’s expectations, or achievement of any Participant goals unless the Terms and Conditions expressly provide otherwise.
9.4. The Company bears no responsibility for actions of the Administrator and/or the Moderator performed in good faith for the purpose of compliance with this Policy and the Terms and Conditions, including content removal and access restriction, provided that applicable law is complied with.
9.5. The Company does not assume an obligation to store User Content or ensure its preservation, except to the extent and in the cases expressly required by applicable law and/or the Terms and Conditions.
10. Procedure for Amendments and Final Provisions
10.1. The Company has the right to amend this Policy by publishing a new version on the Company’s Website: (ссылка на Ethics Policy на сайте https://physical-transformation.com/pwp/). Unless otherwise provided in the Terms and Conditions, the new version of the Policy applies from the date of publication. Continued participation of the Participant in the PWP Chat after publication of the new version confirms the Participant’s consent to the amendments.
10.2. The invalidity of a separate provision does not affect the validity of other provisions of this document. The Policy is interpreted, taking into account its purposes.
10.3. To the extent not regulated by this Policy, the relations between the parties are governed by the Terms and Conditions and applicable law.
